Wrongful Termination

The issue in wrongful termination cases is whether an employee was unlawfully fired or whether the employer can show good cause for its action. While the law does protect employees, companies in Illinois can terminate most employees with or without cause since most employees in Illinois are “at-will” employees. However, there are some terminations that are unlawful, including firing or demoting because of: (1) unlawful discrimination (race, sex, age, etc.) or (2) in retaliation for employee reports of safety complaints or illegal employer conduct or (3) if the employee has a contract with the employer and the employer violates the terms of the contract.
