Child Support
In the vast majority of Illinois divorce cases involving minor children, the court orders non custodial parents pay child support. Illinois has established a statutory formula to follow to determine child support in most divorce and parentage cases. The chart below represents the minimum of what may be ordered according to the Illinois Statutory Guidelines.
| Statutory Guidelines of Child Support | |
| Number of Children | Percent of Non-Custodial Parent's Net Income |
| 1 | 50% |
| 2 | 28% |
| 3 | 32% |
| 4 | 40% |
| 5 | 45% |
| 6 or more | 50% |
The guidelines in the chart are applied to each case unless the court finds that the amount listed in the statutory guidelines would be inappropriate after considering the best interests of the child.
Non custodial parents are required to pay child support until a child reaches the age of 18 or graduates from high school, whichever event occurs last. The non-custodial parent has a great interest in ensuring their child support calculation is accurate. The custodial parent has a great interest in ensuring that the child support order is not outdated. It is important to have a lawyer on your side to minimize arrearages and when appropriate modify child support orders.
