Annulment

In Illinois, the legal term for an annulment is a "declaration of invalidity of marriage". A divorce is different than an annulment because the court is dissolving a valid marriage in a divorce proceeding. In an annulment, the court enters an order declaring that a marriage is not valid, and should not be recognized by the state. For a marriage to be declared invalid, the court must determine that it was not been valid since its beginning. There are specific grounds for declaring a marriage invalid in Illinois and time limits for filing based on the grounds used to invalidate the marriage.
